The Terms of Service (TOS) apply to all Services provided by Hostyro, powered by ixooweb IT Solution, to you throughout the entire Term or Renewal Term. All customers are required to agree to these terms and conditions before signing up for any hosting plans or services offered by Hostyro. By using our services, you agree to use only licensed and legal third-party software. Hostyro reserves the right to suspend or cancel your access to any services if we determine that the account has been used inappropriately.
General Terms
(i) Hostyro reserves the right to refuse service and access to its servers to anyone. Our services must be used for lawful purposes only. The transmission, storage, or presentation of any information, data, or material in violation of any law or regulation is prohibited.
(ii) The following activities and content are strictly prohibited:
- Topsites, Ponzi or pyramid schemes, prime bank programs, bank debenture trading, cryptocurrency/bitcoin miners, forex, e-gold, proxy, bots, spam bots, mail bombers, port scanners, IP scanners, mail harvesting scripts, brute force scripts, chat rooms, banner rotators, file dumps, or using disk space for secondary storage.
- Illegal activities such as the sale of illegal pharmaceuticals, explosives, or hosting malware, warez, phishing materials, lottery, gambling, pirated software distributions, or websites promoting illegal content.
- Promoting or linking to websites that promote human trafficking, prostitution, or escort services.
- Hosting or linking to child pornography or exploitative content.
- Hosting adult materials such as pornography, erotic images, or any lewd or obscene content. The classification of "adult material" is at the sole discretion of Hostyro.
- Uploading or embedding audio, video, or high-resolution images without authorization.
- Hosting illegal material such as copyrighted works or misleading content.
- Warez, including but not limited to pirated software, ROMs, emulators, hacking tutorials, and hacking tools.
- Hosting games or gaming-related material of any kind. Violations will lead to immediate account termination.
- Hosting IRC servers or connecting to IRC networks without permission. Violations will result in service suspension and possible termination.
Abuse of Resources
Your hosting account may be terminated for any of the following reasons:
- (i) Attempting to compromise or compromising any network device owned by Hostyro or any other entity. This includes port scanning and vulnerability scanning. Such actions will be investigated and may lead to immediate termination.
- (ii) Launching or attempting to launch Denial of Service (DOS) attacks directed at Hostyro or from our servers.
- (iii) Hosting illegal software, source code, or material used to commit illegal acts. This includes exploits, hacking tools, and illegal tutorials.
- (iv) Hosting material that infringes on copyright or trademark laws, including pirated media or software.
- (v) Hosting defamatory or private information without consent or violating intellectual property rights.
- (vi) Any attempt to undermine or harm Hostyro’s servers or services.
- (vii) Using excessive system resources (25% or more for over 90 seconds) may result in account suspension or a requirement to upgrade your plan.
- (viii) Disrespect towards any member of the Hostyro staff will result in account termination without refund.
Unacceptable Resource Usage
- (i) Running cron jobs with intervals shorter than 15 minutes.
- (ii) Running MySQL queries for longer than 30 seconds.
- (iii) Using 25% or more of system resources for longer than 90 seconds.
- (iv) Exceeding 5GB in any individual mailbox or 50GB across a domain’s mailboxes.
Unsolicited Commercial Email / SPAM
- (i) The transmission of unsolicited commercial or bulk email (SPAM) using Hostyro’s services is strictly prohibited.
- (ii) Violations will lead to account suspension, and a full-scale investigation will be launched. Access may be restricted to prevent further violations.
- (iii) If found guilty, Hostyro reserves the right to restrict, suspend, or terminate the account. Law enforcement may be notified if necessary.
- (iv) Accounts causing Hostyro’s IP addresses to be listed in spam databases will be suspended immediately, and a ₹5000 administrative fee will be charged. Reinstatement requires removal of the offending content.
- (v) A second violation will result in immediate account termination, and an administrative fee of ₹10000 will apply. Severe cases may lead to permanent removal from Hostyro’s network.
- (vi) Hostyro prohibits the use of services to post messages or advertisements that violate any newsgroup or mailing list rules.
- (vii) Hosting of publicly accessible “open relay” SMTP or anonymous remailers is strictly forbidden.
Commercial Advertising – Email (SPAM) / UNSOLICITED COMMERCIAL EMAIL (UCE)
- (i) Spamming or sending unsolicited emails from our servers, or using email addresses maintained by us, is strictly prohibited. Violation of this policy will result in immediate deactivation of your site with no refund. Hostyro, powered by ixooweb IT Solution, will be the sole authority in determining what constitutes a violation of this provision.
- (ii) To ensure optimal server performance, we have set limits on the number of outgoing emails allowed per domain per hour. The maximum limit applies to the highest hosting plan, with lower plans having reduced limits. For shared hosting customers, up to 20 outgoing emails per hour are allowed. Reseller users can send up to 20 emails per hour per cPanel account, and cloud hosting customers are allowed 40 outgoing emails per hour.
- (iii) We do not guarantee inbox email delivery with any of our hosting plans.
Support Scope
As a hosting provider, Hostyro focuses primarily on network-level support, managing and troubleshooting infrastructure and connectivity issues. Support related to script-based issues, such as assistance with developing or troubleshooting specific scripts or software applications, falls outside the scope of our services.
Backup Policy
- (i) Your use of Hostyro services is at your own risk. You are responsible for backing up all your user content. Hostyro does not guarantee that backups of your account or content will be maintained. Any loss of data is at your own risk.
- (ii) Hostyro is not responsible for data loss under any circumstances, and you agree not to hold Hostyro liable for such occurrences.
- (iii) It is your responsibility to take backups of your site on your personal computer. Hostyro makes no guarantees about backup availability.
- (iv) We advise subscribing to an automated data backup add-on for regular backups and data protection.
- (v) In case of hardware failure or software corruption, non-subscribed backup clients will receive a fresh cPanel provision. Data restoration must be performed by the client.
Uptime Guarantee
- (i) Scheduled maintenance by Hostyro or our network providers does not count toward the uptime guarantee.
- (ii) Hostyro is not responsible for failures caused by third-party services.
- (iii) Hostyro is not liable for delays or failures caused by circumstances beyond our control, including but not limited to government actions, war, sabotage, natural disasters, strikes, telecommunications issues, or third-party software and hardware failures.
Account Security and Company Systems
- (i) You are responsible for preventing unauthorized access to your account. Misuse of your account, including security breaches, is your responsibility.
- (ii) Keep your password secure, as it provides access to your account.
- (iii) Do not share your password or account access with unauthorized users. You are accountable for any consequences of unauthorized use.
- (iv) Attempting to obtain another user’s password is strictly prohibited and will result in service termination.
- (v) You must implement security measures to prevent unauthorized access to your account.
- (vi) Attempting to bypass security measures on any network, server, or account is strictly prohibited. This includes accessing data not intended for you, probing other networks, or using tools designed for compromising security, such as password guessing programs or network probing tools.
- (vii) Attempting to interfere with any network, host, or service (e.g., through denial of service attacks) is prohibited. Violators may face criminal or civil liability. Hostyro will fully cooperate with investigations of network security violations, including those involving law enforcement.
- (viii) You are responsible for ensuring that all scripts or programs installed on your account are secure, and that directories have the correct permissions. Setting directory permissions to 755 or more restrictive levels is recommended. If your account is compromised due to weak passwords or poor security, Hostyro reserves the right to suspend or terminate your account.
- (ix) Accounts found accessing third-party networks or systems without authorization will be suspended. You must provide documentation proving that you have permission to access any third-party network.
- (x) Accounts found to be compromised may be disabled or terminated. If you fail to clean up your account after notification, Hostyro may keep your account disabled. Upon request, we can clean up your account for an additional fee.
- (xi) Hostyro reserves the right to migrate your account to another data center to comply with data center policies, local laws, or technical requirements, without notice.
Late Payment or Non-Payment
- (i) Unpaid invoices may result in the suspension or termination of your web hosting account. Your suspended account will only be restored once the outstanding invoice is cleared, after which you will regain access to your data.
- (ii) If your account is terminated, any data residing on it will not be restored and will be treated as a new account. Failure to renew your subscription on time may result in additional charges on your invoice.
- (iii) We will not activate new orders or packages for customers with an outstanding balance on their account.
Domain Payments
- (i) Domain Registrations: Once a domain is registered, no refund is applicable.
- (ii) Domain Infringement: You cannot register a domain name that infringes upon a trademark or brand, especially if it is used in a business providing similar goods or services. Examples: Flipkartsale.in, bajajfinancecs.com, adtyabrlafnanc.co.in.
- (iii) Domain Renewal: We will send reminders to renew your domain one day before expiry. We are not responsible for any failure or delay in the renewal process. Once renewed, no refunds will be given.
- (iv) If a domain is not renewed within 25 days, it will enter "restore mode," where an additional fee of ₹12,500 is applicable for restoration, along with any late fees.
- (v) If the domain is not renewed within 45 days, it will be moved for deletion and made publicly available. Recovery from our end will not be possible at that stage.
Upgrade & Downgrade of Existing or Purchased Plans
- (i) Once a plan is purchased, downgrading to a lower tier or level is not permitted.
- (ii) The decision to purchase a specific plan implies acceptance of its terms, including the understanding that downgrades are not allowed.
- (iii) Upgrades to higher-tier plans may be available, subject to terms and conditions.
- (iv) Hostyro reserves the right to modify or update plans and their features, but such changes will not force involuntary downgrades for existing customers.
Cancellation Process
- (i) If you wish to discontinue our services, you can request cancellation through your client area. You must first clear all pending dues (if any).
- (ii) You may choose immediate cancellation or request that cancellation occur after your subscription period expires. Immediate cancellation will result in the loss of access to your hosting plan/service, while delayed cancellation will allow you to use the service until the prepaid term ends.
- (iii) You are responsible for backing up all your data before placing a cancellation request. Once your request is processed, all data on our servers will be deleted and cannot be restored.
Taxes
The prices listed on the site are exclusive of taxes. To view the total price including taxes, refer to the Cost Calculator for each plan. The final invoice will include taxes, and the taxable amount is non-refundable.
Indemnification
- (i) The customer agrees to protect, indemnify, save, and hold Hostyro, powered by ixooweb IT Solution, harmless from any liabilities, losses, expenses, and claims, including attorney’s fees, arising from any service provided, or product sold by the customer.
- (ii) The customer agrees to indemnify Hostyro against liabilities arising from:
- (a) Injury to persons or property caused by products sold in association with Hostyro services.
- (b) Loss of electronic files furnished by the customer.
- (c) Copyright violations or defective products sold in association with Hostyro services.
Support Abuse
We treat all customers with respect and expect the same in return. If our staff feels you are consistently demeaning or rude, your account may be suspended, and you may be asked to take your business elsewhere. In such cases, we will provide 10 days' notice to find a new host. No refunds will be applicable.
Defamation
Hostyro is committed to providing a respectful environment for all clients and employees. Defamation, including making false statements about Hostyro, powered by ixooweb IT Solution, with the intent to harm its reputation, is prohibited. Clients involved in such activities will be given 7 days to move their data, after which services will be terminated.
Limitation of Liability
- (i) To the maximum extent permitted by law, Hostyro, its officers, directors, employees, and third-party providers are not liable for any damages, direct or indirect, arising from the use of the services, including but not limited to loss of profits, data, or business interruptions.
- (ii) You agree that Hostyro's liability for any claims will be limited to the amount paid by you for the services in the 12 months preceding the claim. Some jurisdictions do not allow the exclusion of liability, and in such cases, the limitation will be to the extent permitted by law.
Dispute Resolution and Jurisdiction
- (i) In the event of any dispute, both parties will use reasonable efforts to resolve it through consultation and negotiation.
- (ii) You agree that the Courts of East Singhbhum, Jharkhand (India), have sole jurisdiction over disputes related to this agreement, and all matters will be governed by Indian law.
Price Changes
Service prices may change depending on vendor pricing. Hostyro, as an authorized partner of several license providers and domain registrars, may be forced to adjust prices accordingly. You are advised to review billing information regularly.
Change of TOS
Hostyro, powered by ixooweb IT Solution, reserves the right to modify these Terms of Service at any time. If changes are required by law or are related to new services, they will take effect immediately without prior notice.
